A Westland Hialeah Senior High School freshman accused of stabbing a senior in a school bathroom appeared in juvenile court Wednesday where he learned he'll be staying behind bars.
The 15-year-old suspect, who NBC 6 is not identifying because of his age, is facing an aggravated battery charge in Tuesday's incident at the school at 4000 W. 18th Avenue.
The teen was appointed a temporary public defender who requested his release on home detention with a monitor.
"While perhaps the incident alleged was not the smartest of choices it does sound like it was a mutual combat as even alleged in the A-form, and so two juveniles perhaps making bad decisions that weren't the smartest but making them mutually," the defense attorney said.
The judge however decided the teen will be kept in secure detention while prosecutors consider whether they may move the case into adult court.
Miami-Dade Public School officials said the freshman and senior got into an altercation and during the fight the freshman pulled out an X-acto knife and cut the senior in the chest and forearm.
Witnesses said the fight started because the senior stepped on the freshman's shoe. The 18-year-old senior was taken to Palmetto Hospital with a non-life threatening injury, officials said.
